Terms of Service

1. Eligibility and account

The Service is intended for professional use by body-art and beauty professionals. You must be at least 16 years old to create an account. You are responsible for the accuracy of your account information and for all activity on your account. Keep your credentials private and notify us immediately if you suspect unauthorised access.

2. Subscriptions, billing, and cancellation

Beautique offers paid subscription plans billed in EUR through our payment processor, Creem. By subscribing, you authorise us to charge your chosen payment method at the start of each billing period until you cancel. Prices, included quotas, and features are described on the pricing page and may change from time to time with notice.

You can cancel your subscription at any time from Account → Subscription. Cancellation stops further charges; your plan remains active through the end of the billing period you've already paid for. We do not offer refunds for partial billing periods except where required by law.

If you upgrade from Monthly to Annual, you can choose to switch immediately — which starts a new annual subscription and charges the full annual price; any unused credits on your current monthly period are not refunded — or to defer the switch to your next billing date with no immediate charge. Downgrades from Annual to Monthly only take effect at your next billing date, since you have already paid for the annual term.

3. Quotas and fair use

Each plan includes a monthly quota of enhancements that resets on your billing day. Unused enhancements do not roll over. If you exceed fair-use limits or attempt to circumvent quotas (e.g. sharing an account), we may suspend or terminate access.

4. Your content

You retain all rights to photos and content you upload ("Your Content"). By uploading Your Content, you grant Beautique a limited, non-exclusive licence to process, store, and display it solely to provide the Service to you — for example, to produce enhanced outputs, generate captions, and display them back in your account. We do not use Your Content to train models, and we do not share it with other users.

To produce the enhancements you request, Your Content is transmitted to one or more third-party AI image-processing providers — Google (Gemini API, accessed via Google Cloud), OpenAI, and Anthropic — as described in the Privacy Policy. The specific provider used at any given time may change as we tune quality and reliability. These providers process Your Content only to return the requested output and are bound by their own data processing terms. They do not retain Your Content beyond what is necessary to return the response and do not use it to train models on identifiable user content. By using the Service, you authorise this transmission. If you do not authorise it, do not upload content to the Service.

You confirm that you have the right to upload Your Content, including any necessary consent from clients depicted in the photos. You retain the unrestricted right to download, post, sell, or otherwise use the enhanced outputs we generate for you, subject to applicable law and any third-party rights in the underlying photo.

5. Acceptable Use Policy

You agree not to use the Service to:

• Upload content you don't have the right to use.
• Generate, upload, or share NSFW, sexually explicit, or sexually suggestive content, including nudity and pornographic material. Beautique is intended exclusively for professional body-art and beauty portfolio work.
• Generate, upload, or share any sexual content involving minors. This is strictly prohibited and may be reported to the relevant authorities.
• Impersonate another person or misrepresent your affiliation.
• Circumvent quotas, resell access, or probe the Service for vulnerabilities without authorisation.
• Interfere with the Service's infrastructure or use it to send unsolicited messages.

We may suspend or terminate accounts that violate these Terms or applicable law, without refund where prohibited conduct is involved.

6. Service availability and changes

We work to keep the Service available and performant, but we don't guarantee uninterrupted access. We may change, suspend, or discontinue features from time to time. If we make a material change that affects a paid plan, we will notify you by email or through the Service.

7. Intellectual property

The Service, including the Beautique name, logo, interface, backgrounds, and software, is owned by Beautique and protected by intellectual property laws. These Terms don't grant you any rights in our branding beyond what's necessary to use the Service as intended.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (to the fullest extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that every enhancement will meet your expectations, nor that the Service will be error-free or uninterrupted.

9. Limitation of liability

To the fullest extent permitted by law, Beautique's aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) €100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence or wilful misconduct).

10. Termination

You can close your account at any time from Account → Delete account. We may suspend or terminate your access if you materially breach these Terms or if we're required to by law. On termination, your account data and photo library are removed within 30 days, as described in our Privacy Policy.

11. Governing law and disputes

These Terms are governed by the laws of Georgia, the Provider's place of establishment, without regard to conflict-of-law rules. If you are a consumer in the European Union, you also benefit from any mandatory consumer-protection provisions of the country where you reside. Disputes will be resolved by the competent courts of the Provider's jurisdiction, subject to any mandatory consumer-protection venue rules.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. The "Last updated" date at the top of this page always reflects the most recent version.
